In order to sell your photos or say you have a studio/gallery . . . .?
. . . do you have to be officially licensed in any way with your city/county/association of any kind?
I'm an advancing amateur photographer and would like to sell my work online - I have no delusions about it being my only income, but a few bucks here and there would be nice. I specialize in primarily nature photography - landscapes, animals - and also enjoy street photography. I have no plans to have a proper "studio" in which you'd do portraits. Since I won't have an actual "business", do I need to do anything legally in order to sell my work?
I see people all of the time posting on craigslist, etc., offering their (albeit poor) photographic services, and occasionally they'll have "Studios" or some such term after their name. I somehow doubt that they have an actual studio but are using the term to seem more "legit".
So what's the consensus on this situation?
Most states require that you collect sales tax on all sales, regardless of how small of a business you have.
If you are selling through another vendor like a gallery, they will collect the sales tax for you, so you do not need a business license.
However, if you sell a single 8X10 to someone without collecting the appropriate taxes, you are likely violating laws in your area. Whether or not you will actually get fined or arrested for it would probably depend on how big of an operation you have.
It might seem like a pain to take the time to get licenses, but there are benefits, specifically when it comes to deducting your business expenses on your income tax.
